Service

The Short Version

By purchasing a product, booking a service, or using anything on kindahstudios.com, you agree to these terms. If you disagree with any part, please do not use our services.

Kindah Studios ("we," "us," "our") is a creative design studio operating in the United States, providing branding, social media content, video editing, website design, marketing materials, product design, and digital educational products.

These Terms of Service ("Terms") apply to all visitors, clients, and customers who access or use our website, services, or digital products. By placing an order, making a payment, or submitting a project brief, you confirm that you have read, understood, and agree to be bound by these Terms.

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.

Permitted Use

You agree to use our services and products only for lawful purposes. You may not:

  • Resell, redistribute, or sublicense any Kindah Studios digital product without written permission
  • Use our designs, templates, or content to misrepresent yourself as Kindah Studios
  • Reverse-engineer, copy, or repurpose proprietary creative assets delivered to another client
  • Use purchased digital products to create derivative products for resale without a commercial license agreement
  • Submit false or misleading project information when booking services

Intellectual Property

Upon full payment for a custom service project (brand identity, website, marketing materials, video editing), you receive full ownership of the final deliverables. Source files, templates, and working documents are transferred to you at project completion.

Digital products (ebooks, guides, templates sold in our shop) are licensed for personal or internal business use only — not for resale or redistribution — unless the product listing explicitly states commercial licensing is included.

Kindah Studios retains the right to feature completed client work in our portfolio, case studies, and marketing materials unless you request otherwise in writing before project commencement.

Limitation of Liability

Kindah Studios provides creative services and educational content in good faith. We are not liable for any indirect, incidental, or consequential damages arising from your use of our services or products, including but not limited to lost revenue, missed opportunities, or third-party platform performance.

Our total liability for any claim arising from a service or product purchase shall not exceed the amount you paid for that specific service or product.

Governing Law

These Terms are governed by the laws of the United States. Any disputes that cannot be resolved informally will be handled through binding arbitration or in the appropriate courts of the United States.

Digital Products — 30-Day Refund Guarantee

We stand behind our digital products. If you purchase an ebook, guide, template pack, or any other downloadable product from Kindah Studios and are not satisfied, you may request a full refund within 30 days of your purchase date.

To request a digital product refund, email hello@kindahstudios.com with the subject line "Refund Request — [Product Name]" and your order confirmation number. We process approved refunds within 5–7 business days back to your original payment method.

Refund Exceptions

Refunds will not be issued for digital products purchased more than 30 days ago, for products gifted or transferred to a third party, or in cases of suspected abuse of the refund policy (e.g., requesting a refund immediately after downloading and using the content). We reserve the right to decline refund requests that appear fraudulent.

Custom Service Projects

Custom creative services (branding, web design, video editing, social media content, marketing materials) involve significant time and resource investment. Refund terms for service engagements are as follows:

  • Before work begins: Full refund of any deposit paid, minus a $50 administrative processing fee.
  • After concept delivery (before revisions): 50% refund of the total project fee. The deposit covers research, discovery, and initial concept work already performed.
  • After revision rounds begin: No refund. Work delivered at this stage represents substantial creative labor. We will continue working toward your satisfaction within the agreed scope.
  • After final delivery: No refund. Final files have been delivered and approved.

If you are unhappy with the direction of a project at any stage, please reach out to us. Our goal is always a successful outcome — we will work with you to resolve concerns before they become disputes.

Monthly Retainer Services

Social media management, paid ads management, and consulting retainers are billed monthly and may be cancelled with 30 days written notice. Fees already paid for the current billing period are non-refundable. No partial-month refunds are issued unless the cancellation is due to a failure on our part to deliver agreed services.

Results from applying the information in our products are not guaranteed. Your outcomes will depend on your individual business situation, the effort you invest, your market conditions, and many factors outside our control.

Ebooks & Guides
PDF format. Delivered via download link immediately after purchase. No physical item is shipped.
Template Packs
Delivered as downloadable files (Canva, Figma, or editable formats). Access via download link or shared file URL.
Digital Courses
Delivered via hosted video platform or password-protected member area. Access credentials provided by email.
Licensing
Personal and internal business use only. Commercial resale or redistribution requires a separate commercial license. Contact us to inquire.

No Results Guarantee

Income figures, engagement metrics, or business outcomes mentioned in our products are illustrative examples — not promises of what you will achieve. Every business is different. We provide information and frameworks; applying them successfully depends on your specific circumstances and execution.

Delivery & Access

Digital products are delivered to the email address provided at checkout within minutes of payment confirmation. If you do not receive your download link or access credentials within 30 minutes, please check your spam folder and then contact us at hello@kindahstudios.com.

We are not responsible for delivery failures caused by incorrect email addresses entered at checkout, email provider spam filters, or email system outages outside our control.

Checkout Notice

By clicking "Purchase" or "Buy Now" on any Kindah Studios checkout page, you confirm that:

  1. You are at least 18 years of age or have parental/guardian consent.
  2. You have read and agree to these Terms of Service and our Refund Policy.
  3. You understand that digital products are non-transferable and for your use only.

Service
Agreements

Project Commencement

Custom service projects (branding, web design, video, social media content) begin upon receipt of a signed project agreement and payment of the agreed deposit. Verbal agreements or email confirmations alone do not constitute a binding service commitment on either side.

Your deposit secures your spot in our production queue. We operate on limited monthly capacity — deposits are non-transferable to other projects or future dates without written consent.

Revisions & Scope

All service packages include a specified number of revision rounds (typically two). A revision is defined as a set of consolidated feedback addressing the delivered work — not a new direction or concept change.

Requests that fall outside the original project brief or that require significant additional creative work will be quoted separately and billed as add-on work. We will always notify you before performing out-of-scope work and obtain your written approval.

Client Responsibilities

Timely delivery of the project depends on timely feedback and materials from you. Kindah Studios cannot be held responsible for project delays caused by:

  • Late or incomplete delivery of client-provided assets (logos, photos, copy, brand guidelines)
  • Extended periods of client non-response (more than 5 business days)
  • Frequent changes to the project brief after work has commenced
  • Third-party dependencies outside our control (domain registrars, hosting providers, platform approval processes)

If a project goes dormant due to client non-response for more than 30 days, we reserve the right to archive the project. Re-activation requires a new deposit equal to 25% of the original project fee.

Payment Terms

Service projects are invoiced in two parts: a deposit (typically 50%) at project commencement, and the balance upon final delivery before files are released. Monthly retainers are billed in advance on the 1st of each billing cycle.

Invoices unpaid beyond 14 days of the due date may incur a 1.5% monthly late fee. We reserve the right to pause active project work on accounts with outstanding invoices.

Plain English Version

We collect only what we need to serve you. We don't sell your data. We use standard industry tools to run our business. Here's the full picture.

When you purchase a product, book a service, or submit a contact form, we collect:

  • Name and email address (required to deliver your order or respond to your inquiry)
  • Billing information (processed securely via our payment processor — we do not store full card details)
  • Business information you voluntarily provide in project briefs and forms
  • Website usage data (pages visited, session duration) via analytics tools

How We Use Your Information

We use your information to fulfill your orders, deliver your digital products, communicate about your project, and occasionally send relevant updates about new products or services. You can unsubscribe from marketing emails at any time using the link in any email we send.

We do not sell, rent, or trade your personal information to third parties.

Third-Party Tools

We use the following third-party platforms to operate our business. Each is governed by their own privacy policy:

  • HubSpot — CRM, email marketing, and website hosting
  • Payment Processors — Secure payment collection (Stripe or HubSpot Payments)
  • Google Analytics — Website traffic and usage analytics
  • Meta (Facebook/Instagram) — Advertising and the Meta Pixel for ad performance tracking

If you visit our website, the Meta Pixel may collect anonymized data about your visit to help us measure the effectiveness of our advertising. You can opt out of Meta's data practices via your Facebook account ad preferences.

Data Retention & Your Rights
